Question
On October 1, 2008 Beverly, Josie, and Bambi, moved into a large apartment complex located in the city of Harborview. Joseph Storey, the owner hired Ms. Tremp as the property manager. The building had a NOTICE of CONDEMNATION posted on the front of the building. The property manager promised the tenants those repairs
will be completed before they moved in. When questioned about the condemnation notice the tenants
were told that Mr. Storey is a wealthy and well-connected local politician.
When they arrived to move in, they found the condemnation notice still on the door. They immediately contacted the property manager. She apologized for the delay in completing the repairs. She authorized them to enter the apartment and inspect it to determine what repairs are required.
The property manager told the tenants if they were willing to make the repairs, the first 2 months would
be free rent and they could keep anything they found in the apartment. The tenants and their friends
cleaned and repaired the apartment. They rented carpet cleaners, paint sprayers and numerous cleaning
supplies. The apartment was fumigated for mice and cockroaches.
The property manager told them to purchase whatever kitchen appliances they needed to make the apartment livable. The tenants were assured that the owner would reimbursed for their out of pocket expenses.
Weeks later the tenants continued to have problems with infestations of mice, cockroaches, as well as the persistent odor of cat urine. Also, a uniquely fetid odor was becoming stronger. In fact, two of the tenants became physically ill and had to be treated at a local health clinic.
These problems persisted into November at which time the tenants submitted a list of additional complaints, including a broken skylight in the lobby, broken light fixtures in the hallway leading to the apartment, garbage disposal had stopped working, leaking roof in the hallway, and return of the mice and cockroaches.
On December 1, the property manager showed up unannounced to inspect the apartment. She opened the door and discovered Beverly asleep on the sofa. Beverly woke up and complained about the odor. A tenant, from another apartment, also complained about the odor. All three women looked for the source of the odor and discovered the source was a dead animal in the walls of the hallway. As Bambi was tearing out a hallway wall, she discovered a small chest containing valuable gold coins, silver coins, and an original manuscript of the beginnings of the world written by Professor Sagittarius. An appraiser estimated the value of the coins in excess of $2,500,000.
Bambi learned that she had inherited over a million dollars from her Uncle Alphonso. Bambi is the only heir named in the Will. During probate Sammy, an alleged brother of her uncle, claimed his share of the inheritance. The Will was admitted to probate and the Judge has yet to decide if Sammy should receive anything. Bambi was very close to her Uncle and his extended family. None of the family knew of Sammy, although they do not deny the resemblance between Sammy and Uncle. Through Court records, it has been determined that Sammy has been in a state mental institution due to severe addiction to drug and alcohol addiction for the past 50 years.
Bambi did not tell anyone what she found in the wall or its value. She placed the small chest in a safe deposit box at the Bank of Humans.
The tenants seek your advice regarding their legal rights and remedies described above.
