It occupies a street corner in Texarkana, a city that straddles the border of Arkansas and Texas. Across the street -- and across the state line, which runs down the middle of the street - is Roberto's Tacos. The two businesses compete for customers. Recently, Alfonso has begun to suspect that Roberto's is engaging in competitive behavior that is illegal. Alfonsos manager overheard several of Roberto's employees discussing these illegal competitive tactics while on a break at a nearby Starbucks. Alfonso files a lawsuit against Roberto's in a federal court based upon diversity jurisdiction. 1). Answer Roberto's has a basis to file a motion clamming to federal court .Because law of equality is applicable to both parties.Alfonso has filed a case on Roberto's , in this case Robertos can also mention his option or can file a case.

Answer Alfonso dont have any option other than to accept the courts judgement.Now in this case if Alfonso feels that all the documents , evidences he has against the Robertos are correct , then he can go to the next court & can file a case .Still he has option to a file a case in next level of court

Alfonso manager what he heard about the employee talking near to the coffee shop , this may not be correct evidence .This can only be taken as reference. Yes I am absolutely agree with the statement ,this may be unethical. For this a counter mechanisms or some new approach is important that can help Alfonso to have a better evidence to make available in front of court or juridical system.

Here though its been heard by Alfonoso manager still its not the strong evidence unless & until it is captured.
