Question

The American Medical Association has proposed establishing a state medical board to discipline physicians and resolve medical malpractice claims. Under this proposal, which has not been adopted in any state so far, the board would have authority to change some legal rules pertaining to medical malpractice, limit attorney fees, and use guidelines to promote consistency in damage awards. Briefly discuss whether you think this would be better or worse than the way we deal with medical malpractice now. Use specific examples to help explain your position.

Medical Industry & Malpractice Resolution

In present day situation due to rapid increasing population and healthcare problems, there is a need of robust technology to deal with misuse of medical power. Doctors these days charge hefty amount just for counselling and there are certain loopholes in this industry that are utilized by these practitioners to gain money fooling people. Recent findings suggest that ever 13 out of 15 patients pay more money in hospitals and their medical bills. Let’s take this case in direction to how these days they make extra money:

Scenario 1: In medical bed hospitals usually charge daily amount for the benefits provided. Usually the charging mechanism states that if you vacate the premises before 10 am you won’t be charges for the day, if you vacate before 1 pm half of the days charge would be deducted, and after that full day charge is permissible. Usually patients tends to leave hospital as soon as possible but unless doctors clears one cannot leave hospital. They will usually clear a patient between 12:30 to 1 in which paperwork and payment settlements would lead to time extending to 1pm. This results in full day charge. Once the patient leaves the premises the wardrobe is changed and new patient is admitted. During admission time it doesn’t matter which time you arrive. You will be charged full for that day. So in this case the hospital made double amount in same time for single bed.

Scenario 2: During operations and counselling doctors would suggest or insist you to go for check-ups even if you had gone thorough it earlier. They have commissions fixed with these institutes for every patient they send. This results in more money wasted for the same result.

So according to me this would be welcome step from government to control the malpractices followed by medical industry.
