Question
Tenant’s Rights and Responsibilities. You are a college student and plan to attend classes for nine months. You sign a twelve-month lease for an apartment. Answer fully each of the following questions:
1. You have a summer job in another town and wish to assign the balance of your lease (three months) to a fellow student who will be attending sum-mer school. Can you do so? (See The Landlord-Tenant Relationship .)
2. You are graduating in May. The lease will have three months remaining. Can you terminate the lease with-out liability by giving a thirty-day notice to the land-lord? (See The Landlord-Tenant Relationship .)
Explanation / Answer
Yes, I can reassign the lease or make a sublease to a fellow student with the consent of the landlord. However, being the original tenant, I am not relieved of the obligations to the landlord under the original lease. 2. No, it is not possible to terminate the lease before the expiry of the lease period even by giving thirty days notice, unless the lease expressly permits me to do so.
