Explanation / Answer

Breach of contract involves not honoring of binding agreement or bargained-for exchange by one or more of the parties to the contract.

Revelations Perfume and Cosmetics Inc. v. Prince Rogers Nelson: In this case, Revelations perfume sued the musician Prince and his music label. Prince had reneged on an agreement to help market the perfumes of Revelations. Prince had promised to personally promote the company’s new perfume named after his 2006 album “3121,” and to allow his name to be used in packaging. Susequently, Prince did not give interviews for the campaign and did not give a current photograph for press release.

The legal issue was whether any malicious intent was present in the actions of Prince. Court found no malicious intent on Prince's part. However, he had not fulfilled his promise and was held to pay for Revelations' out of pocket expense. Prince behavior was not ethical. Ethically, Prince should have given interviews and given a current photograph as a part of his ethical and moral obligations.
