According to the case below; Julia has been a cashier for the company since the store opened 6 years ago. she is approaching age 70. The employers have been urging her to retire, but so far they have had no luck. It seems Julia's life revolves around her work. Her children live far away, and she has no hobbies. The employers ask their attorney, if there is any way they can force July into retirement. The attorney asks them about Julia's job performance. The employers explain that Julia is extremely competent. However, Julia's age and appearance do not fit the youthful and up-to-date image that the company wishes to project. They recently hired 19-year-old Erika, whom they describe as being really "hot." Julia is training Erika. The employer's plan to make the switch in 2 weeks, on Julia's birthday Are The employers justified?

The retirement from activity is a natural process that is essential for various reasons such as, the health conditions of a person may not permit to work any further, the pre-decided age limitations set by the employer before the person is taken onboard, to avail pension or other post-retirement benefits, etc. As per the case, what it could be understood is that, there has been no retirement age limit set by the Organization, particularly for the employees. In such a scenario, as long as Julia is willing and competent to work, she may be ideally allowed to.

However, if there are any changes in Company’s HR policies regarding the recruitment and retirement of the employees, or if they resort to certain clauses mentioned in the Labor Act, concerning the retirement age or criteria for the older employees, then in such a case, Julia’s retirement could be justified. But, to make that act more justifiable, the Company must also take into consideration all these years that Julia dedicatedly devoted to the Organization and accordingly, grant her the post-retirement benefits, to make good for loss of pay due to the retirement decision.

It is further the rule of nature as well to make way for the new. The new ideas and technology, the young thoughts, are also essential to keep the Company going, in this regard. Imparting training to the reliever so that there is an uninterrupted flow of work in the Organization, is always essential when one is hired to replace the other. Hence Julia does need to train Erika and give her best to make Erika befitting the Organizational values and its activities. On the other side, considering the age Julia is getting into, it is actually her time to relax and devote sometime for herself and to her health. She needs to cease the Office activities and explore in her own possible way, the society and the community. She could step out of her office life, make new friend and thereby enter into a carefree lifestyle of enjoying her life, giving pace to herself and at the same time, earning enough via her retirement benefits, to keep her sustained in her rest of the part of life. She does need to make her way for the new ones to enter into the Organization so that the right time of training that she imparts to Erika, shall only help the Company to let the show go on, even when she suddenly becomes invalid, one fine day.
