Explanation / Answer
Answer: ( E)The possessor must occupy the property with the express or implied permission of the owner.
Adverse possession would not be called as adverse possession if the land in possession is by the express or implied permission of the owner. This was decided in the court case of BP Properties Ltd v Buckler, Dillon LJ stated that Mrs. Buckler cannot have adverse possession of the land that is owned by BP as BP as consented for her staying for free for lifetime.
Answer: (c )Easement by implications
The reason is the land before a parcel of it was sold to KiKi was same and the road was accessible from the property. Now by virtue of Easement by implications even if a part of land is sold to KiKi, she can still use the road as the use of the part of land that Kiki owes now for accessing road before and after sell continuous as well.
