Alan Vitt purchased an iBook G4 laptop computer from Apple, Inc. Shortly after the one-year warranty expired, the laptop stopped working due to a weakness in the product manufacture. Vitt sued Apple, arguing that the laptop should have lasted “at least a couple of years,” which Vitt believed was a reasonable consumer expectation for a laptop. Vitt claimed that Apple’s decriptions of the laptop as “durable,” “rugged,” “reliable,” and “high performance” were affirmative statements concerning the quality and performance of the laptop, which Apple did not meet. Alan vitt purchased a laptop which comes with Limited warranty of one year. Claims are made on the basis of taglines used by the apple Incorporated. Apple has specifically describe the laptop as durable and rugged as an specification rather than providing the specific term into the warranty.
There is no claim applicable as the limited warranty period is over.
There is no contractual obligation as the product has passed the one year mark and the warranty was only limited to 1 year.
In this specific case as the warranty for the specific product was over and the claim is made after the warranty is over there is no such issue or probability of getting a claim. Asking for a claim in it is specific case would not be appropriate as the warranty for the product is over and the claims cannot be made on the basis of tag lines used by the product provider.
Apple is not liable for the ibook as the warranty time which was provided by Apple is already over and there is no legal obligation after passing 1 year mark from the purchase of the specific product. Court should rule in the favour of Apple.
