The provisions of this Article are not intended to create an independent right of action. To the extent practical, the Employer will be proactive in addressing situations where there are health and safety concerns relating to working The Employer recognizes that information shared by employees in confidence must not be shared or discussed with others unless the employee agrees that it is appropriate. This includes, but is not limited to, information about an employee's intent to seck employment outside the employee's immediate office, and information about an employee's mental or health or personal problems. In the event there is a regulatory requirement to convey confidential information, the Employer will inform the employce as soon as it rocognizes that this may be necessary and employees as well, should refrain from discussing with others, except when there is a legitimate business need, negative and potentially hurtful comments regarding an employee's performance, as well as any negative or potentially hurtful comments regarding an employee's mental health or professional At no time will the act of an employee making a complaint or exercising hisher rights, as it relates to the provision of this Agreement or any other employee right, be the basis for any form of retaliation by the Employer.

Mary Jo works in one of Global Power Tools’ factories. She is a member of the union and has come to the union for help. According to Mary Jo, she told her supervisor, Jane Smith, that she was depressed and needed to adjust her work schedule because she was experiencing financial difficulties and was going to start working a part-time job. Mary Jo even heard her supervisor say that Mary Jo was a “mental case”.

Global power tools' Union collective Bargaining Agreement is emphasized on heartful and respectful relationship between employer and Union members or employees to ensure a healthy working environment.

As in the given Case,Mary joe a worker of the global power tools factory requested to her supervisor, Jane Smith to change her work schedule as she was going through depression and hard financial situations.

Being the member of the union she kept her problem in front of her supervisor. It was the duty of supervisor to look into her matter and provide her some financial help and to help her in managing her work schedule so that she don't had to join part time job for more money to meet her financial needs.

Instead of helping her out the supervisor, Jane Smith told all the problems of Mary to a co-worker Henry which was against the terms of the given agreement. The supervisor was not supposed to share confindential informations about a worker to others.

Mary jo also found Jane Smith talking about her mental condition to Henry, the co-worker and making joke of her by calling her 'mental case'. This conduct of supervisor towards the worker is pathetic and against the conditions of the agreement.
