Marya Callais, a citizen of Florida, was walking one day near a busy street in Tallahassee, Florida, when a large crate flew off a passing truck and hit her, resulting in numerous injuries. She incurred a great deal of pain and suffering, plus significant medical expenses and could not work for 6 months. She wants to sue the trucking firm for $300,000 in damages. The firm’s headquarters are in Georgia, although the company does business in Florida. As Marya’s lawyer decide where the case can be filed, where it should be filed and why.

Explanation / Answer

As Marya's lawyer, I would decide that the case can be filed both in Florida as well as Georgia since the trucking firm has its headquarters located in Georgia and does its business in Florida, as a result both the states have jurisdiction over the trucking firm, so case can be filed anywhere in Florida or Georgia state courts.

Moreover Marya lives in Florida, so for her ease she should file the case in Florida and not is Georgia. Because if filed in Georgia court then she need to travel there, hire a lawyer there and all the witnesses need to travel to Georgia.
