Question

Some experts in the field of labor relations believe that when a union can pose a credible threat of a strike to management in the collective bargaining process, both parties—union and management—are motivated to move in the direction of a settlement and reach a labor agreement. They also claim that without a credible strike threat, the two parties are less likely to arrive at a joint agreement.

   1. What is the basis for this justification for giving the union the privilege of exercising its right to strike?

   2. Do you agree or disagree with this argument? Explain your reasoning.

   3. After reading about the complexities and challenges between Management and Labor Relations, what was your "ah hah" moment or greatest takeaway from this discussion?

Explanation / Answer

1. The union is given privileges for the right to strike according to the Section 7 of the National Labor relations act that states that employees forming a union have the right to strike fit the purpose of collective bargaining process or for their protection. The justification for such right is that:

-Sometimes, striking becomes the only option for the employees to protect themselves.

-This gives them a chance to avoid being in the mercy of the employers.

-This gives a sense of power to them and the employer not to consider them week.

-It ensures that government doesn't ban the people on a strike.

2.I agree with the argument, because without the right to strike the employees would not have any power that they can exercise over the management to fight for their rights, as the management is concerned mostly about gaining bigger profits and keeping their employees in the same state without any improvement to them. Hence, this ensures that the two parties arrive at a joint agreement that is for the benefit of the employees without any harm to the management.

3. My greatest gateway from this discussion was that this right should be exercised by the union in periods of time when they feel the need that they need to bargain or feel unprotected, as this gives them power over the management, without this which would not be possible and the management will implement their actions on the employees for its benefits.
