How preventive law process may limit liability of Fitness club.

1. The Identifying risks - definition of Harassment stated above is a general one & may be made more specific for particular work space depending upon interactions that happen may happen at that place. It should be made very clear & this should be first step in defining what really Harassment will mean here. This is a part of identifying risks at the work space and should include systematic assessment of the layout, employed personnel, prospective customers, catchment geography and other factors.

2. The Assessing risks - Next will be to detail each of the risks, define them in clear terms so that there is no ambiguity to what it means for anybody and everybody. Now each of these risks needs to be classified into one of such categories as Low risk, Medium risk & High risk category. Before doing this, rationale for classification must be outlined so that there is an objective method of carrying out this activity. When all of the identified risks are classified in either of the categories of Low, Medium & High an overall risk profile of the work space related with Harassment issue may be generated. This will be an important output to understand and prioritize sequential activities and action plans. For e.g. somebody addressing a stranger by name can be low risk. An incidence of accidental touching a female by a male member can be a medium risk while trying to forcibly pursue a friendly relationship with a female who is not interested may be taken as a high risk incidence.

The Evaluate risks - For each of risk categories & individual risk contributing elements, subsequent impacts must now be listed which must include the impact on the organization's image, business, environment, culture, other members, society etc. The impacts must also be classified into Low, Medium and High impact categories for prioritization & action planning. For e.g. a low risk may also lead to a high impact if not dealt with properly and a high risk incidence can be completely avoided through suitable processes & vigilance controls. Therefore it cannot be generalized and the nature & extent of the impact of every risk must be clearly defined. This will generate an impact profile for probable risks and an organization can now define and prioritize its key focus areas for prevention.

4. The Designing a preventive law plan - preventive law plan must be able to address each of identified risks and their impacts irrespective of their nature and extent through suitable mechanisms & an action plan must be defined and documented and aligned with all key stakeholders. Preventive law plan may include signing of documents such as Code of Conduct, Prevention of Harassment at workplace etc. as undertakings from the members of the fitness club. It will also include regular audits, inspections & proactive controls like deploying CCTVs at selected locations and displaying notice that all members are in the reach of the camera. There can be positive reinforcements like posters at the workplace encouraging respect for one another and good and acceptable behaviour. There can be many more of such practices that can be included in the preventive law plan.

5. The implementing the preventive law plan - implementation should be carried out in a planned way through project management & monitored for adherence to implementation plan & timelines. Implementation may be preceded by a pilot implementation so as to include any design changes / design additions that are possible / that can be needed for an effective implementation.
