Question

Karen Goldberg’s husband was killed in a terrorist bombing in Israel. She filed a suit in a U.S. federal court against UBS AG, a Switzerland-based global financial services company. She claimed that UBS aided in her husband’s killing because it provided services to the terrorists. UBS argued that the case should be transferred to another country. Like many nations, the United States has a common law system. Other nations have civil law systems.

Question: State your opinion on where the case should be heard and explain why.

Explanation / Answer

The case should be transferred to another country. In Us there is a common law system that means It has no comprehensive compilation of legal rules and statutes, the decisions are largely based on precedents which follow the judicial decisions that have been made on similar cases. But in other country where civil law exists has a legal code which addess all the cases which can be brought before the court and provide appropiate punishment for each offense.
