The statute madates that new warning labels comprise the top 50 percent of front and rear panels of cigarette packages and 20 percent of the area of each advertisement. Pursuant to this authority, the Food and Drug Administration (FDA) selected nine images that would accompany the statutorily prescribed warnings. These inlcuded images of cancerous lungs and dead bodies. Tobacco companies challeneged the rules, complaining that the governement had no evidence indicating that the graphic images would actually curtail tobacco use. May the FDA require that tobacoo companies place graphic images on tobacco packages? Explain

Explanation / Answer

FDA has this hypothesis that the size of the images will cause the users to be appaled and all smokers will be come more concious even though most of them are.

They already have idea that new smokers will be more inclined not to use the product.

The hypothesis is not directly proven correct

So it is clear that this method might be useful only in case of new users who are starting to smoke, they might get appaled and stop smoking, as they are not fully aware and these images might stop them from getting addicted..

Though to get direct proof it will take time and long term trials, if FDA makes it manadatory to use these images it will be mandatory for all tobacco packages. And one more reason for it to believe it to be effective is the reaction of the tobacco companies, as the companies have all come agaist it which means this could affect them economically and sales figures drop.

So FDA may enforce this step to curtail tobacco use.
