Question
Write an additional 1-2 page paper in which you provide a market analysis of three jobs of your choosing in Detroit, Boston and Sacramento (The same set of three for each city). In this paper you will make a recommendation for the market range for each the positions, and how the position should be classified (Exempt/Non-Exempt/Salaried). Make a case for your assessment referencing FLSA Guidelines, and explain what challenges such an assessment might face in practical terms. Include at least one Exempt and one Non-Exempt position in your analysis.
Explanation / Answer
FLSA : Fair Labor standards act recommends and regulates the basic requirements for any job position including setting minimum wage standards, overtime pay and the set hours after which over time starts, restrictions on the employment of children and record keeping.
Exempt:This position is usually a salaried employee who is not paid overtime and are not governed by any regulations that are afforded to non exempt positions. This position along with the salary have additional benefits of incentives or commisions. Examples for these kind of roles include executive, administrative or professional positions.
Non-Exempt positions are positions that are governedby regulations of minimum wage, overtime payment, etc.
Salaried employee may have to work whenever they are ordered by the employee be it a weekend or on holidays without overtime regulations.
Let us see the following table which shows the three job positions which are similar in the three regions and what they are paid.
Non-Exempt
Car Sales executive
Salaried
Hospital intern
The challenges that the employers face in the three regions while following FLSA guidelines are that the guidelines fail when there is differences in the amount of work that is involved be it due to higher population or ifference in paperwork related to the same positions at different places. For example, Sacramento has living standards that are higher than the national average by 17%, but compared to detroit and boston it is still lower. The job role for operations manager here, may be restricted to 40 hours but there may be not much to do for the individual and so a consultant would besufficient and more effective. But this consultant cannot be taken on as neither non-exempt or exempt as the job role is already structured under one format by FLSA guidelines.
Exempt:Operations ManagerNon-Exempt

Salaried
