Your cousin is a finalist in an extreme eating contest. If she can eat the most hamburgers at the final round tomorrow, she will win a prize of $10,000 plus a trip for two to Hamburg, Germany. She tells you that if she wins, she will take you with her on her trip. Excited about the possibility of a trip to Germany, you take a vacation day from work and go to watch her compete and you cheer for her and yell encouragement to her as she is eating. To your amazement, she eats 17 hamburgers and wins! Excited about your upcoming travel, you go shopping and buy new luggage for the trip. The next time you see her she tells you that she has decided to take someone else to Germany with her. Discuss your rights and the likelihood of success if you sued her for breach of contract. The total scenario is based on a promise that is being made my cousin regarding her winning trip to Hamburg. Formally or officially there is no contract between us and hence I do not possess the right to sue her for breach of contract. There is just a promise that she made and even if there is emotional and financial lose incurred by me I cannot sue her for breach of contract in this context.
