For the past ten years I’ve run this company as my family. It’s my creation, my life and my money.
As you know my nephew, Jason came to work with us last year. He is useless and isn’t old enough to have his driver’s license yet.
During a family gathering and after a few drinks, I bet him and his mother (my sister) that I would make him a vice-president if the Pats did not win the Super Bowl this year.
Yesterday, my sister (Jason’s mother) called and asked when Jason will get his promotion. She said Jason already bought his new suit and business cards.
Jason’s father is a slimy Personal Injury Lawyer and I think I am in trouble. I know you are taking a business law class from that brilliant lawyer so you should know.
Is there any agreement/contract?

No, this is not enforceable because it was just a promise that the Boss made to Jason in a party that he would be promoted to the position of the Vice President if the pats did not win the super bowl this year and yes this cannot be treated as a contract. If we look at the contract law we will observe that in this case, there is neither an offer nor an acceptance hence this cannot be considered as a contract.
Yes, there is an ethical issue because even if there is no contract, the individual promised the same to Jason and his mother and ethically he needs to keep his promise which he is not planning to keep. I personally feel that if promises are made that should be kept because that is what a promise is all about.
