Plutonium Resources refuses Rogers’ application, reasoning that only men or women no longer in their childbearing years are entitled to work with this dangerous substance because of danger to prospective fetuses. Is this a valid reason?

3. Lenore Wilkenson is shopping for a new dress at Oak Valley Department Store. When she decides to try a few on to see how they look, Wilkenson is confronted by Derek Sanders, who is safeguarding the changing area. Wilkenson complains to the store manager that she refuses to use the changing area with a male at its entrance. This is the seventh complaint in Sanders’ first month of work. Oak Valley discharges him. Sanders believes this conduct to be unfair. How would you advise him?

1. Yes, Robinson has a case on grounds of discrimination on the basis of gender as when the applications were invited, the firm would have clearly called out for the required gender rather than rejecting Bruno after he applies to the position. Also, there should be firm reason for not inviting male candidates as day-care teachers if it is at a policy level.

2. Yes, it is a valid reason to reject Misty’s application if she is in her childbearing years considering the possible harm or danger the work would result in to prospective fetuses. This is not considered as a discrimination rather, it is considered as a responsibility of the firm to ensure the employee safety.

3. Sanders should understand the limitations of what he can do at work considering there should be certain exceptions as per the request of customers who should not be offended for his deeds. It is important to consider whether the customers are comfortable in changing dress with the person around.
