Question
3. Sarah Jameson read an advertisement in The Inde- pendent inviting her to become a member of the New Era DVD Club. Jameson chose several DVDs that were listed in the advertisement. She paid only $1 for those DVDs and became a member of the DVD club. In doing so, she also agreed to purchase four more DVDs in a year's time. Under 7. terms clearly specified in the advertisement, Jameson knew she would receive a brochure 12 times a year listing selections. The brochure would also identify the main selections, which would be sent to her automatically unless she sent a reply form to stop the shipment. In effect, New Era has made Jameson's silence acceptance. Is this a legally effective tactic? Explain.Explanation / Answer
Yes, I believe that this quite an effective tactic and legal as well because in order to become a member of the organization, there are certain steps that the individual needs to take care of and if that is being done will be considered as acceptance and there is no need of conveying anything separately. By this approach the process is effective because there is minimum documentation and paperwork associated with the same and makes the process convenient for Sarah.
