Problem 2: Identify potential legal and ethical issues in the given scenario – and briefly explain each (if you identify a lot – list all of them and explain the top three)
A professor, who teaches advanced courses in computer programming, presented a course project to his students. The professor proposed the problem and supplied the necessary facts. The problem was to create a program that automated the enrollment process for a private secondary school in the area. The enrollment problem in the school is real (not fictional) and the students were informed that the best project would be donated to the school and in that way help the community. At the end of the semester, the students that did the best job denied the professor the disc containing the code for the enrollment program, saying that it was their intellectual property and that it was subject to negotiation. This action was taken after they made sure the professor had assigned the final grades. The case is under consideration by a legal assistant.
Explanation / Answer
Ethical issues:
1) Teacher-Student Relationship is something that should mot be held to a bargain and is of utmost importance, which was sidelined by the students.
2) Intellectual Property Right to the program is partially with the professor.
3) Students should understand that it was the chance given by the professor for them to create the enrollment programme an is being donated but the professor should make sure to give all credis to the students to maintain status quo.
Legal Issues:-
1) Pofeessor in some way or the other share some of the Intellectual rights as it was the facts prvided by him that the students could have written the code.
2) Students should be charged with fellony for holding the professor to bargain for alloting the grades but professor should also give the full credit to the students who designed the code while donating the code.
