A jury found that Home Station was negligent in their hiring and retention of William as an employee, and entered a verdict against Home Station for $75 million. The Home Station's liability policy provided insurance coverage to Home Station for only $50 million.

William will be able to collect worker's compensation benefits, because William was injured within the course and scope of his employment.

The employees will be able to collect worker's compensation benefits for their injuries, but will not be entitled to any of the $75 million in damages for Home Station's negligence in hiring William.

Home Station's shareholders may be personally liable for the remaining $25 million, because Home Station's severe acts of negligent hiring resulting in catastrophic harm to others.

Explanation / Answer

The jury’s verdict is correct in the light of the events. Home Station was negligent in reporting the case of William to the authorities and doing a bad reference check and hiring policies. This negligent act has also put the lives of other workers at risk.

If the company has taken the right steps, this tragedy could have been avoided and the penalty incurred by the company as well as the injury to the other innocent employees.

The shareholders will also be liable because they will be considered as the party to the severe negligence of the company towards right hiring policies and creating a dangerous workplace for other employees, fully knowing the previous record of William. They failed to take appropriate actions and report it to competent authorities for their necessary actions.
