Express consent is a type of a consent which is provided after an asked question or proposition. This is quite evident in the medical field, where the medical procedures require the patient’s consent before operating.
Similarly, in order to store an employee’s data, companies need Express Consent from the employees. There are many contracts where such consents are required.
Informed Consent
Informed consent also requires explicitly asking for the consent through the medium of asking the question and receiving the positive response from the person concerned. Informed consent is a lot detailed in nature than Express Consent and needs time for lengthy discussions before getting/providing the consent.
For example, if a patient requires a complex surgery, the medical staff will explain in details the risks involved, procedures and possible course of action and patient’s consent before operation/surgery.
Express consent is the permission from the party involved for some requirements or procedures given explicitly through the verbal medium or in writing. This kind of a consent needs little legal recourse and is not very complex. However, a proof of consent must exist in case required for the affected and operating parties involved.
Statutory consents are the legal and the stated rules/regulations permissions that a party needs in order to carry out any changes which are governed by the federal or state laws. These consents are generally part of the contract and are set of standard consents where each party is supposed to provide the consent which is stated by the law of the land and does not depend on the individual requirements.
