Not only the US senator but even a normal person can sue XYZ corp for infringement of data privacy rights. According to which the subject(owner of the data) must be consulted before the processor(the entity that collects the data) can share their personal information(PI) and Sensitive Personally Identifiable Information(SPII) with third parties.

A subject may choose to share its information with processors if they think the might benefot from it, as was the case when the US senator thought of using the services of XYZ corp. But XYZ corp cannot sell their data without their consent.
