SECRET INSTRUCTIONS FOR UNION REPRESENTATIVES Your client is Mr. Roberto Ramirez, the Chairman of MWP-Brazil's company labor union. The MWP-Brazil company union "Union") has loose affiliations with various other unions in the same industry and with the Federation of Brazilian Office Workers Unions (the "FOBOw") However, there are no legal or other binding ties to the Federation or any other group or party in Brazil. The Union is a typical company union in Brazil in which certain exceptional employees of the Company rise through company ranks and, after serving as union head for a two to three year team, then move into management positions. As counsel for Mr. Ramirez, you want to be sure that he will not jeopardize his future with the Company by mis-handling this dispute. On the other hand, you want to make sure that the employees of the Company continue to have confidence in their Union and that the reutation of Union's management is not damaged by allowing outside unionizing forces to take over the Union Mr. Colon, the most senior of the dismissed employees, is a member of the Brazilian Communist Party. He has been a problem employee of MWP-Brazil since shortly after his being hired by MWP-Brazil some 20 years ago. The Human Resources Department of MWP-Brazil, working together with senior union representatives, has expended a good deal of effort over past years attempting to isolate Mr. Colon from influence with the general employees of MWP Brazil. The result has been Mr. Colon's position as head of his Section (which contributes little to the Company and which effectively isolates him from influence in the overall employee group). Management suspects that Mr. Colon is informing the Communist Party of Brazil with respect to MWP's international activities, but has never been able to find concrete evidence of such conduct. Several of Mr. Colon's subordinates monitor Mr. Colon's activities on behalf of the Union and management. Three of the terminated employees, Ms. Rodriguez, Mr. Bandero and Mr. Da Silva, have indicated to the Union that they wish to leave the Company following this incident. Mr Ramirez suspects that they have found better jobs and, in any event, are tired of working in a non-productive section of MWP-Brazil. On behalf of the entire Board of MWP, I would like to express my deep regrets for the stern action taken on the employees resulting in their dismissal and would like to apologize for all those actions. We understand that it was not the most appropriate action that could have been taken and looked not so respectful for the employee morale as a whole and lacked the professionalism we followed at the MWP over the last few Decades.
While we would do all the necessary arrangements to end this crisis , i will ensure that appropriate and necessary steps would be taken to prevent similar incidents in the future and MWP would strive to respect all the Brazilian Labour customs, rules, regulations and sentiments of the employee groups and their culture.
I deeply value our professional bonding and the relationship we are attached to and firmly believe that our teamwork will continue to produce solid work that will benefit MWP and our Clients.
