Question
An architectural firm employs 300 employees and mostly works on government contracts. A newly hired HR director realizes there are multiple problems he needs to address to comply with federal laws. Write a 2-page paper using the current edition APA format and citation style to identify the relevant employment laws for each situation.
1) One of three female workers in the accounting department complains to her supervisor that she feels uncomfortable during breaks because other employees routinely tell off-color jokes.
2) A veteran of the Vietnam conflict experiences lower-back pain after sitting for extended periods of time. He has applied for promotion to a supervisory position that has traditionally involved spending most of the workday behind a desk.
3) The HR director receives a call from a local newspaper. The reporter wonders how the firm wishes to respond to calls from two of its employees alleging racial discrimination. About half of the firm’s employees (including all of its partners and most of its architects) are white. One of the firm’s clients is the federal government.
Checklist: After carefully reading over the above scenario, identify the following:
Identify at least one law, constitutional amendment, or executive order that is relevant to each situation described in items 1–3.
Identify the government agencies that would provide oversight concerning issues 1–3.
For mastery:
o Describe each law identified.
o Describe the role of each agency identified.
Explanation / Answer
1) One of three female workers in the accounting department complains to her supervisor that she feels uncomfortable during breaks because other employees routinely tell off-color jokes.
This issue is governed by the Harassment. This law takes care of the complaints arising due to harassment of any sort arising from non-professional remarks. This category of a complaint will come under the Non-Sexual Harassment.
2) A veteran of the Vietnam conflict experiences lower-back pain after sitting for extended periods of time. He has applied for promotion to a supervisory position that has traditionally involved spending most of the workday behind a desk.
This issue is covered under the Uniformed Services Employment and Reemployment Rights Act. This act creates the procedures and acts for the rights related to military leave.
3) The HR director receives a call from a local newspaper. The reporter wonders how the firm wishes to respond to calls from two of its employees alleging racial discrimination. About half of the firm’s employees (including all of its partners and most of its architects) are white. One of the firm’s clients is the federal government.
This issue will be covered under the Equal Employment Opportunity Act that maintains the law relating to the discrimination arising from issues like caste, color, religion, ethnicity, etc.
The other act that covers this issue is Employment Discrimination Laws which takes care of discrimination arising due to skin color, national origin, mental or physical disability, ethnicity, genetic information, and pregnancy or parenthood.
The umbrella agency for managing all these cases is Department of Labor. All such issues must be reported directly to US Department of Labor in case of non-response and action from the individual’s company.
