Question

3. I bought a new BMW in Germany and had it shipped in a container from Hamburg to a dealer in Washington DC. Relying on my deep knowledge of the Interstate Commerce Act I realized there was no need for additional insurance. The BMW was moved under a through bill of lading issued by Hamburg Süd from Hamburg to the BMW dealership in Washington. Two scenarios A. The ship ran into England while trying to pass through the English Channel and was totally wrecked. The BMW is a total loss. B. The container arrived at Baltimore and was loaded onto a truck without being opened and moved to the dealer’s in Washington. When it was opened my BMW had been reduced to scrap.

Explanation / Answer

3.

A.

As the brand, BMW was bought from Germany and it was decided to ship the BMW in a container to a dealer who was in Washington DC. As per the owner’s point of view, it does not need any additional signing of any insurance to do for the shipment. Later when the BMW arrived it was found that it is totally lost and wrecked. So the scenario was like as per the Interstate Commerce Act it can be shipped from Germany to Washington DC very easily but it was passed through a ship in England through the English Channel. The BMW is necessary to be taken care of but as the forceful insurance was done so the shipment is not taken care of properly and these leads to a loss in new BMW. All the factors were known by the shipment authority that loss/damage during shipment the amount will be forwarded as it was accredited with insurance.

B.

BMW can easily be sent through a bill issued by Hamburg to Washington DC, but it was loaded on a truck. When the container arrived in Baltimore it was not opened. It was directly sent to the dealer in Washington. The dealer found that it had been scrapped. The new BMW look was totally hampered as it was bought with an exciting look. It was the total responsibility of the shipping organization that they carelessly shipped the items and it got scrapped. The BMV can be moved through a container from Hamburg to Washington DC by just issuing a bill from Hamburg Süd. As per the owner of the BMV say’s, that according to the guidelines of the Interstate Commerce Act, there is no need to sign any additional insurance for sending any shipment from Germany to Washington DC. The circumstances were all known and it was going to happen, it might be the reason to sign the additional insurance by the shipment authority. So it was quite a harassment that should not be expected in this dealing as the BMV was hampered very badly.
