Question
Write a short statement informing a bank of its liability when it deposits a customer's check in the wrong account.
Three weeks ago, you deposited a $1,000 payroll check at your bank after having signed your name to the back of the check and writing the words "For Deposit Only—Account Number 7852837" immediately above your signature (Account Number 7852837 is your checking account). Since then, you have discovered that the bank did not deposit the check in your checking account, but instead deposited the check in your other account at the bank, a "money market" account. As a result, you have "bounced" three checks totaling $583, and incurred $75 in bounced check fees. Write a 1-2 page letter to your bank advising them of your legal rights in this situation
Explanation / Answer
The Manager
XYZ bank
New York, USA
Subject: No deposition of my check into my account.
Greetings!
Respected Sir,
I want to draw your attention to this serious issue I am facing from your bank. I am having account in your bank from last 5 year and its number is XXXXXX. As I am your valuable and regular customer there is issue that I have faced in past days. I have deposited a $1000 payroll check into my account clearly state on it that “For Deposit only – Account number 7852837” and signed with my name on back side of that check. I have deposited that check in order to clear another check 3 check totaling $583 which were issued by me to another persons, since your bank did not deposit that check in my account those check which have been issued by me bounced and incurred me $75 for check bounce fee, so this issue is been faced by me only because that bank wrongly deposited my payroll check into another account which have caused me lower my reputation. I suppose that this issue could bring me some legal actions because of those bounced check and I do not bear any mistake in this matter, your bank mistake has caused me $75 that supposed to give me under legal liability. I am legally bound to relieve that bounced check fees since there is not mistake in this issue.
Kindly look into this matter and resolve before matter goes out of hand, as I don’t want to bring lawsuit against your bank since my reputation has been lowered due to this.
Yours faithfully,
