Scenario

Mr. Con Fused has been an employee at Regional Hospital for the past five years. His employment there was recently terminated. The reason for the termination was: Inability to follow instructions. However, Regional has adopted an "at-will" policy. So in reality, no reason has to be given for the termination. Never the less, Mr. Fused was very upset at his termination....so upset, that he went to the media with his story.

You work for the human resources department at Regional. The hospital attorney is preparing for a news conference regarding the termination of Mr. Fused. In an effort to help the attorney, you draft justifications for an "at-will" termination of a hospital employee. What are your reasons for supporting this policy? Your job is to convince the public that this is a necessary and useful policy.

Now you work for a public advocacy group that has decided to help Mr. Fused. You hold a news conference in response to the hospital's news conference. What flaws do you find in the hospital's position? Why is "at-will" wrong for the medical industry? As a business organization our primary objective is to generate revenue and incur the maximum amount of profit from the same and this "at-will" policy is just to support the organization at times of need. I believe that a healthy attrition is quite justified, expected and fair for an organization who is possessing the objective of doing business. I understand that the policy may seem a bit ruthless but again, an organization cannot afford to incur loss in order to be considerate and we need to look at the facts that we do not use this policy frequently, it is used to protect the interest of the organization and I believe any organization will follow the same path in such situations.

We agree that an organization is here to do business by generating revenue but the organization should also understand that employees are an important stakeholder of the organization too and their interests need to be protected. An employee cannot be terminated if the person has not violated any non negotiable guidelines, this is the industry practice and my client here has not violated any of them. The medical industry needs to be ethical because they deal with human lives but by terminating an employee at will the organization has set a bad example where they actually did not think of the employee at all.
