AB Pneumatics, Inc. manufactures hydraulic ram systems for motor vehicle lifts with 100 employees in a facility consisting of two buildings and a parking lot. The buildings are an older, small, administrative office and a large manufacturing plant. The older administrative building houses four male managers and six female clerical employees and contains separate bathrooms for male and female employees. The new manufacturing plant was built six months ago and has 80 male and 10 female employees working there. Plant employees receive two, ten minute work breaks and one 45 minute lunch break per shift. However, the new plant has only one bathroom for male employees only. Female plant employees on break are required to leave the plant facility and walk across an open parking lot to the older administrative building to use the female bathroom located there.

Analysis of Facts and law for the working of EEOC

Equal employment opportunity commission (EEOC) Was enacted to enforce civil rights of workers at workplace. This law was administered to investigate particularly discrimination at work place. Such discrimination is with respect to race, sex, age,disability,nationality, religion etc. Of a person at work place.

In this case, One manufacturing unit does not have wash rooms for female employees. It means that company management ignores the minimum work place need for female employees which is the basic requirement. It comes under the LGBT –Related sex discrimination Claims of (denying employee equal access to a common rest rooms.) So that EEOC can file law suit for gender discrimination against the company. Here it is the desperate treatment for female employees. Direct evidence is helpful to draw inferences on that. So victims can file charge with EEOC. Employer should be very careful about the minimum requirements of female employees at work place if they appointed female workers. Because gender discrimination laws are very much strong. So, an employer has to update or formulate better working policies in support gender equality.

There should be proper communication channel between employer and employee with respect to the work place issues and law. There will be continuous   amendments in the law with respect to this. Employee and employer both should be aware of it for smooth functioning of an organization. This case comes under the compliance of LGBT discrimination at work place.

Thus Supervisor should investigate on this issue and take proper action before it goes to the court. It is better to resolve the matter voluntarily or through conciliation. This law is enforced by both federal and state laws. Training, conferences, presentations are really helpful for the implementation of this law.
