A company covered by Title VII advertised for a position of Marketing Manager. The company hired three people: Jane, white female, age 38; Charlie, age 44, black male, Lin, a Chinese female, age 25. Garza, a Hispanic male, aged 47 had applied for the job but was not selected. Later he found out that 6 Hispanics including himself had applied for the job (gender of the six other than himself unknown) and none was hired. He also gathered informally that 3 Blacks, 5 Whites, and 2 Asians had applied for the job out of which the above three were hired. He feels that the company has discriminated but being unaware of the EEO laws has sought your guidance. He wants to know if there is any evidence of discrimination and the bases on which he could have been discriminated against. Discuss if the company practiced discrimination based on any of the prohibited categories with a justification.

Equal employment opportunity commission (EEOC) is responsible for the implementation of EEO laws that prohibits the employers from making any discrimination on the basis of race, sex, ethnicity, age and se-xu-al orientation among the other factors and it is not applied in hiring decisions, but also in many other functions such as wage determination and promotions of the employees. With the given details, it can be ascertained that the company has not made discrimination in the hiring because of the following reasons:

1. The company has hired one black male and it could not be possible if the company implemented discrimination based practices.

2. The company has hired two females and it means that there is no discrimination on the basis of sex.

3. The company has hired one Chinese person, it means that company has taken adequate consideration for the ethnic and minority groups and no discrimination took place.

4. The company has hired two individuals over the age of 40 years, then there is no discrimination on the basis of age also.

Just because, no one is hired from a particular community, does not ensure that discrimination has taken place. It can happen due to the following reasons.

1. Lack of required skills, suitability for the job and ineligibility to the profile

2. Limited number of vacancies available in the company

3. Other candidates better positioned and suitable for the jobs

So, it is not the case of discrimination.
