She is being induced early because her blood pressure is sky-high (pre-eclampsia) and the only way to reverse the event is immediate delivery. The delivery goes fine, but 12 hours later the patient suffers a severe brain hemorrhage from the hypertension. Two independent neurosurgeons examined the patient and performed all the required tests and declare her brain dead. The neurosurgeons want to terminate all efforts and disconnect the ventilator. The husband is furious and demands she be kept on "life support".

Explanation / Answer

In California if the surgeon declares thatr the patient has suffered a brain death then the patient is generally announced dead after there is an examination by another surgeon and the verdict of the second doctor is generally considered as the confirmation. In this case the hospital has the right to terminate all efforts and disconnect the ventilator because that is what the law supports because this facilities can be used to save a person whoi is still alive. The situation of the husband can be understood but the law does not support his claim. The law may differ in a different state but in California this is the regulation.
