Federal and State laws provide protection from illegal discrimination. The original definition of illegal discrimination was concerned with disparate treatment; however on the basis of a landmark court case (Griggs v. Duke Power, 1971) a new definition immerged called adverse impact.

Disparate treatment and Adverse impact or disparate impact are two legal terms that defines discriminations based on color,gender,race, national origin, socio-economic status, disability etc in employment, housing, education and other issues.Both of these discriminations are prohibited by Federal and State laws.

Disparate treatment is intentional discrimination .The policies, rules, practices or procedures of an institution that deliberately discriminates a particular group, favoring another group is disparate treatment.Example,if only a particular group of individuals are required to take an assessment test during a recruitment process that is intentionally designed to fail them is disparate treatment.

Adverse impact or disparate impact is unintentional discrimination.The policies, rules, practices and other procedures of an institution or organization that otherwise was neutral but resulted in disproportional impact on a particular group of individuals is adverse impact.Example,in an assessment test during the recruitment process that all the participants are required to take and only individuals belonging to a particular group are eliminated , this is adverse impact.

Discrimination always curbs the human rights of individuals who are discriminated.It hampers the growth and development of society as it never allows the full development of society and it's individuals.
