During the course of her employment, Lake stole pieces of jewelry, including several diamond rings, a sapphire ring, a gold pendant, and several loose diamonds. Over a period of several month, Lake sold individual pieces of the stolen jewelry to Wyatt Watch and Jewelry Corporation (Wyatt). Wyatt had no knowledge of how Lake obtained the jewels. Lake was arrested when Addison discovered the thefts. After Lake admitted that she had sold the stolen jewelry to Wyatt, Addison attempted to recover the jewelry. Wyatt claimed title to the jewelry as an innocent good faith purchase. In a 100-150 word (1/2 page) response, discuss who would prevail in a lawsuit brought by Addison against Wyatt for the jewelry Be sure to give the legal justifications for your response.

Explanation / Answer

Addison would prevail in the lawsuit. In this case Lake had sold the stolen jewelry to Wyatt which originally belongs to Addison Jewelers. The case where the buyer purchases goods from the seller who is not the original owner of the goods and is a thief, the seller’s title is void. Legally there is no title for the seller in case of theft goods which keeps the buyer also without title. In such cases the real owner can recover the goods from the buyer. Here Addison jewelers can recover the stolen jewelries from Wyatt even though Wyatt has done an innocent good faith purchase from Lake. Wyatt can seek damages from Lake.
