After reviewing our current employee handbook, I have come to the conclusion that ABC, Inc. needs a new handbook that better reflects our policies and procedures. This revision will only be for our Minnesota location right now. I will leave the drafting to you since you have the expertise in employment law and you will also have to determine whether the provisions I propose below are even legal. I would like the following included (the wording will be left to you, of course).

• Mandatory retirement: Mandatory retirement at age 60 for printing press operators, maintenance technicians (those employees responsible for repairing printing presses, cutting machines and other equipment used in the printing and other departments) and drivers (those operating large trucks delivering throughout the country printed materials to clients • Mandatory reporting of o Any employment (including part-time and temporary) that employees have in addition to position with ABC, Inc. o Any arrests and convictions for any criminal offenses, regardless of the severity including traffic violations. • Discipline: three strikes you’re out policy. First offense oral warning. Second offense written warning. Third offense termination. Period. • No visible tattoos and body piercing. • Pre-employment tests: All employees must have a high school diploma or a GD from a US high school and must pass an English test to show that they speak English well • Smoking: o No smokers will be hired starting next month o Current employees who smoke must pay more for health care benefits and must attend a program to help them quit smoking

If you determine that it would not be in our best interest to include one of my suggested provisions, please tell me why. I would also like links to any applicable law that you are using when drafting these new provisions, or when you are telling me which ones we can’t or shouldn’t include.

Read the attached Final Project ABC, Inc. Employee Handbook document, an email from Pat Jones, the CEO of ABC, Inc. He thinks the company needs a new handbook so he has proposed some revisions to the handbook that better reflects their policies and procedures.


For your Final Project, complete the following deliverables:

1: Find a template or sample employee handbook online that you will use as the base for your ABC, Inc. Employee Handbook.

2: Rewrite or write the provisions that Pat Jones said that he would like to include in the revised Employee Handbook. Rewrite, eliminate, or keep the other provisions that you find in the sample handbook.

3: Submit a draft copy of the preliminary version of the ABC, Inc. Employee Handbook to the instructor for review and feedback.: 4.Submit a final copy of your ABC, Inc. Employee Handbook incorporating any instructor feedback. Prepare a presentation about your revised handbook that is a maximum of five minutes. Address the following in your presentation:

a) Where did you find the handbook that you used for the base of the ABC, Inc. Employee Handbook?
i) Why did you choose this handbook?

b) Choose one of the provisions that you changed.
i) What was the original language?
ii) Why did you change it?
iii) What is the modified version of the provision?

v) What does that law(s) say that made you realize that you needed to change the language in the handbook that you found?

c) The other provisions that you have comments about (those you edited, eliminated), add a comment in the margin of the Word document that you will submit to your instructor. The comments will explain why you made the changes you did and show your understanding of the laws and legal concepts that we have studied during the course.

While you are preparing your Final Project, keep the following in mind:

a) This handbook is to apply to the state in which you live and work. You must refer to your state's employment laws as well as any applicable federal laws.

b) The provisions that Pat has suggested might not be appropriate or they might have to be changed either slightly or completely. That will be up to you to decide.

c) Just because you find a sample handbook on the Internet, don't assume that it is written well or that it is lawful under Minnesota law or your state's law. Read carefully before determining that a provision can stay.

Other things to remember:

a) Your Final Project will include the ABC, Inc. Employee Handbook as well as the VoiceThread video presentation.

b) Format: Your Final Project should be composed in Word, 1.5-spaced, no more than 12 pages in length (so in other words, you likely cannot include everything that you would include if you were writing this in real life so you will have to choose what to include).

c) You must also turn in an Explanatory Memo in which you explain the reasons for the changes that you made, whether those changes were rewriting a provision, eliminating it or leaving it as you found it. Your explanatory memo must refer to the laws that led you to your conclusion and state your reasoning. The memo must be no more than 4 pages composed in Word.

EMPLOYMENT PRACTICES AND POLICIES

Discrimination free environment:

The company provides an environment which is free from any kind of discriminations and all the employees are given equal opportunities irrespective of caste, color, religion and gender.

Recruitment and selection:

The recruitment process is flexible and candidates with skills, knowledge, experience and dedication towards work are free to apply. The selection is done without any biasness with the help of a written examination or personal interview, as the job demands.

Code of Conduct:

Employees are expected to maintain discipline in the organization, failing to which employees will be warned and then will be terminated from their job. Employees need to report on time and cannot be late for work, apart from emergency situations. Emergency should be informed to the immediate superior, as and when it arises.

Dress Code:

Employees are expected to maintain discipline by following a proper dress code for office. Formal dress code is required to be worn by the employees which should be decent to look and adds grace.

Working Hours:

The employees are expected to work from Monday to Friday, starting from 9:00 in the morning, till 5:00 in the evening. This includes one hour of lunch break for the employees. However employees can be called for work or emergency meetings on Saturdays as well.

Attendance:

It is expected from the employees to maintain proper attendance and do not bunk from work due to unnecessary reasons. Attendance will be recorded in the biometric machine and the employees are expected to complete 8 hours at workplace.

Employee Compensation:

Employees will be paid on monthly basis and the amount will be fixed on the basis of designation held and as per the amount mentioned in the contract.

Warning System:

Any employee found guilty of any kind of offence or breaking any rule will be given oral warning in the first place. And if the same offence is repeated again then a written warning will be circulated and the employee will be given a show cause notice. After which, if found guilty will be terminated from the job itself.

Smoking:

Employees are not allowed to smoke in and around the sitting area as it can be harmful for other employees as well. Although employees are allowed to smoke outside the office premises, only during the lunch breaks. If any employee is caught smoking while working then this can lead to severe punishment or even termination.

Age of retirement:

The retirement age of an employee will be 60 years. No employee can continue with the company after he reaches the said age. Although re- recruiting the employee will be the sole decision of the management and the board.

Whistle Blower Policy:

The company has a strong whistle blower policy which is followed properly. A whistle blower committee is set who is responsible to listen to the complaints of the whistle blowers. Moreover the whistle blowers' identity is kept a secret and not revealed to anyone.
