Officer Guidry and K-9 Officer Miller met to eat supper at McDonald’s. After finishing their meal, Officer Guidry exited the parking lot and noticed a pickup truck disregard a traffic light nearly causing an accident. With K-9 Officer Miller following him, Officer Guidry proceeded to conduct a traffic stop on the vehicle. Officer Guidry directed the driver to exit the vehicle and began to gather from the driver the necessary paperwork needed to complete a traffic citation. While Officer Guidry was writing the ticket, K-9 Officer Miller with K-9 Filou, a narcotics-detection dog, began a walk-around “sniff” search of the exterior of the vehicle. This infuriated the driver who stated, “You need to stop that illegal search you are doing before I call my lawyer!” The K-9 unit continued with the search. By the front passenger door, K-9 Filou detected narcotics inside, thus giving probable cause to search the vehicle. K-9 Miller opened the passenger door and immediately K-9 Filou “hit” on a wrapped container on the floorboard. This container was opened and held a white, powdery substance that looked like cocaine. The driver was placed under arrest; he shouted, “That was illegal! You can’t dig in my stuff for nothing! I am going to have both of your jobs…and the dog’s too!” He was booked in the local jail charged with failure to obey a traffic signal, possession of cocaine, and public intimidation. K-9 Officer Miller knew that he had followed proper procedure because the search was during the traffic stop and did not prolong the length of it as noted in Illinois v. Cabellas (2005).
