Lisa and Mike wanted to have a baby, but Lisa was infertile. Therefore, they went to an infertility clinic where they chose a surrogate mother from a bunch of profiles. A surrogate mother, Amy, agreed to be inseminated with Mike’s sperm and carried the baby. This was not a gestational surrogacy arrangement. In other words, Lisa did not provide her ovum. Therefore, the baby was going to be genetically related to Amy instead of to Lisa.   Because it was considered as beneficial for both parties, without any dispute, a written contract was smoothly made so that Amy would be paid in return for providing her womb to raise the fetus. The payment was to be made after Amy gives a healthy baby to the couple. Nine months later, a healthy baby girl was born to Amy. After carrying the baby for nine months, giving birth, and holding the baby, Amy decided that she did not want to give up the baby and thus would not accept the payment. Since the informal discussion among Amy, Lisa, and Mike did not reach any solution to this conflict between Amy’s desire to keep the baby and their initial agreement, Lisa and Mike decided to bring this issue to a professional mediator. The recommendation made by the mediator will be considered as final unless either one of the parties further files a lawsuit at the civil court. Imagine that you are this mediator. In my judgment, there is a clear attachment between mother and daughter. To remove her from her mother's care would cause a measure of harm. It is the mother who, I find, is better able to meet the baby's needs, in particular her emotional needs.And the biggest factor that the baby is biological child of Amy so her psychological and physical attachment be more to Amy. In particular, the natural process of carrying and giving birth to a baby creates an attachment which may be so strong that the surrogate mother finds herself unable to give up the child. And also since an agreement was signed and the couple can file a case against Amy but still since she is her biological mother preference would be given to her.
