Explanation / Answer

Due process of law means the process one follows to get a fair trial. It is defined in the fifth and sixth amendment. It means the court validates if the government has acted in the correct way within its power to bring in the charges against a certain person. If the laid out processes are followed by the government or government mechanisms then the court ascertains that no violation is done by the government. Any criminalization has to be done by the due process, which means this will happen if all follow the correct procedure only then the criminalization can be upheld. And the due process means there is a chance is to be given to the person in concern, the grand jury decides if the evidences provided are enough and so can issue an indictment. And it also prevents by the fifth amendment the cases of double jeopardy, which means on the same case the same person cannot be charged multiple times, and similarly a person cannot be compelled to be witness against self.

So there are provisions by which it mandates right to trial by jury through the seventh amendment, which will ensure the due processes are followed. Sixth amendment states that the trial must be speedy, in most states it is 45 days unless you waive it. The trial should be in public, to maintain transparency. And it also ensures you have the right to attorney, who can fight on your behalf to give a chance of fair trial. And the basic rights should be informed to the person before charging with any thing so that the legal due process is followed.
