1)      Should soldiers be allowed to join unions? (Hint: consider both the environment and ethics.) Support your answer with a couple of reasons why/why not.

When you join the military, you are giving up your civilian rights. You know going into it that you will not have basic rights like a civilian and there is a chain of command that must be respected and followed. Considering environment, you give up this right when you swear in. My husband is in the military and sometimes he is in downright awful working conditions but doing so for the good of the mission/country. No, I do not believe unions have a place in the military. It is not a job where you can voice your opinions. It is structured to be successful, whatever that may entail for those who enlist. Its mission gives these rights to civilians to enjoy the freedoms that come with civilian life, like being able to join a union.

2)      Can an employer refuse that a Union be created in an organization? Why or why not?

Our text tells us that employers can us a no solicitation rule in the workplace and not allow workers to talk about unionization if it interferes with work (Budd, 2017, p.209). However, it also states that enforcement of this could be considered objectional interference with employee rights to unions. The National Labor Relations Act states as follows “forbids employers from interfering with, restraining, or coercing employees in the exercise of rights relating to organizing, forming, joining or assisting a labor organization for collective bargaining purposes, or from working together to improve terms and conditions of employment, or refraining from any such activity” (Employer/Union Rights and Obligations, n.d.).

3)      Is joining a Union free to employees?

The National Right to Work website states that you may not be required to pay to be a union member but if you do not work in a “right to work” state you may be required to pay (National Right to Work Foundation, n.d.). Our text states that depending on the type of union security clause you may need to pay dues. An agency shop requires employees to pay union dues after being hired on, in order to keep the job. Then it goes further stating that the Right to Work laws outlaw this agency shop (Budd, 2017, p.316). Depending on the state you live in and the terms of your contract you may or may not be required to pay.

Explanation / Answer

1. Unions protect the employees against exploitation, poor work conditions, discrimination on a number of grounds and in the situations where employees and owners have conflicting interests. They provide a collective voice to employees' concerns and assists to bargain for good wages, work conditions and benefits. In military, there are no conflicting interests between the parties or the wage issues, so there is no need of a union. If military unionises due to any reason, country's sovereignty may come under threat if the union chooses to protest at the war / insurgency time.

2. The decision of formation of a union by the employees is not taken in a day. It is a slow process where a series of events involving the management's actions triggers the discontent among the employees and they believe that unionisation is the only option for making their voice heared and getting good bargain for wages and other benefits. Employee friendly policies and continuous assessment of the workers' sentiments is the key for preventing the unionisation. Still, if the workers decide to form a union, they can't be coerced, threatened or bullied against it as per the regulations.

3. Right to work states ban the contractual agreement betwen the employers and the union employees that require workers to pay for the cost of representation, so if someone works in such state, he / she is not required to pay for union fee. In other states where right to work is not in force, the employees may be required to pay a fee to the agency shops for continuing in the job.
