QUESTION: Hassan operates a building company specializing in homes built for the Wave, in Muscat. In order to maintain his high standards of construction, Hassan kept his company small and never had more than two projects going at one time. Sharifa owned land at the Wave on which she wanted to build a house. After hearing of Hassan’s reputation for doing superior work, Sharifa decided that she would have her house built by Hassan. On April 15, 2014 Hassan and Sharifa talked face to face at Hassan’s office about Hassan doing the construction of Sharifa’s house. They agreed that he would do the work. Sharifa said, “But the house must be completed by May 30, 2015 in time for my sister’s wedding”. The contract price, OMR 100,000, was to be paid in instalments every three months until the completion of the house. Was a valid contract formed between Sharifa and Hassan?

As per the contract act. A valid contract is said to be when there are two parties involve for some activity to be carried out with some obligation to fulfil the duty and it should be in WRITTEN . And written is one of the important clause in the contract law . Hence in the given example there was clearly no written statement or contract formed between hassan and sharifa because it was ust FACE TO FACE orally declare the service. Therefore it is not a valid contract .
