Three days prior to a union representational election, the company president called an employee meeting where he discussed the upcoming election. In his speech he said that voting for the union was a futile act , that it would inevitably lead to strikes and that collective bargaining would not bring any benefits or improvements; rather he would make sure that the employees would lose the benefits they already had. The union lost the subsequent election and asks that the NLRB set the election aside. Does the union have a good case? Explain

The Union is putting forth a good case.
As the Company President conducted a meeting, 3 days prior to election ; his meeting agendas has mutilated the viewpoints of its employees or in other words have scared them. The result of such meeting giving agendas such as reducing employees benefits and all would have make them felt in endangered position. As a result of which the election decision got biased , which subsequently means that the election conducted was not very fair as they have biased the viewpoint of electors..
