Question
EXAMPLE: THE STORY OF “WILD BOBIC” Astrid and Bobic work together in a large bank. Bobic has been obsessed with romantic fantasies about Astrid for several months. He discussed his feelings with his therapist, and has been taking anti-depressants. He has falsely told several co-workers that he and Astrid are having an affair. Astrid is, in fact, happily married to Barbarella, and is unaware of Bobic's feelings.
Both Bobic and Astrid are avid square dancers. Both are active in the local country dance club. Astrid and Barbarella were the club’s first same-sex couple. Bobic’s dance partner was his younger sister, Glory. Seeing Astrid and Barbarella at monthly dances only fueled Bobic’s fantasy. One night, Bobic had been drinking, and decided that he and Astrid were meant to be together, and that they needed some money with which to leave the country and start a new life together.
Despite a memo all employees had received indicating that the bank premises were off-limits to them after-hours, Bobic used his key and entered the bank around midnight. Since he was a vice-president, he had access to several accounts in which large sums of money were kept. He only took money from those accounts for which he was responsible, so as not to implicate anyone else. While in the bank, he also took a new laptop computer, which another co-worker had recently purchased for himself. Further, he broke into the president's personal, safety deposit box, in which Bobic knew were kept her passport and that of her husband. He also took several of their credit cards and a gun. As Bobic left the bank, he doused it with gasoline, and set it on fire to cause a delay in figuring what he had done.
Bobic then went directly to the community center where he knew Astrid and Barbarella would be attending the weekly dance club event. Glory was waiting for Bobic when he arrived. He shared with Glory his plan to carryAstrid away and asked Glory to help get Astrid and Barbarella apart. During their next do-se-do, Glory stuck out a foot and tripped Barbarella, severely spraining her ankle. An ambulance was called to take her to hospital for treatment. Barbarella had driven herself and Astrid to the dance. When Barbarella left with her keys, Astrid was left stranded without a ride.
Bobic and Glory offered Astrid a ride home. Once in their car, Astrid was bound and gagged and taken to the airport. There Astrid was injected with a sedative that rendered her unconscious. Bobic then chartered a private plane, telling the clerk that he was taking his unconscious and desperately ill wife to the Mayo Clinic in Minnesota. Supposedly, Bob would have the pilot return the airplane the next day. Bob used the bank president’s credit card to pay for the flight.
Once onboard the airplane with Astrid and Glory, Bobic held the gun to the pilot's head and told him to take them to Rio de Janeiro or die. Bobic found the wet bar, broke into it and began drinking heavily. Although the pilot was worried that Bob would shoot him when they landed in Rio, Bobic let him go. Bobic then took the pilot's seat and took off again. Eventually, Astrid awoke and found out what Bobic and Glory were doing. Astrid told Bobic that she loved Barbarella and would never care for him. Glory persuaded Bobic that a union with Astrid would never be. Once Astrid was fully awake, he and Glory strapped her in a parachute and threw her from the plane. Astrid broke her leg on landing but was otherwise none the worse for wear. Meanwhile, Bobic and Glory flew off in the plane, off into the sunset.
YOUR ASSIGNMENT: Your task is to read the story above. You must identify 5 crimes and 5 torts from the story, no more than 5 of each. You must then list each of the 5 crimes and torts, identifying for each item, who the “victim” is for each offense, who the plaintiff would be in a proceeding, and the acts that make up the offense. Thoroughly explain why your answer is correct. If there are possible defenses available, they should be listed as well. Each of the 10 bundles of information that you must provide is worth 3 points; total value is 30 points. Remember, one point will be taken for each mistake of any kind; be sure to edit and proofread your work. Further instructions for this assignment are in the class syllabus. Due at the start of class on April 22, 2016. NO EXTENSIONS.
