The hotel is not liable for any loss suffered by Torczyner. It is apparent from the facts provided in the case that Torczyner moved the diamonds from the safe when he needed them. There is no clear reason as to why he didn't deposit diamonds at the time of returning to the hotel. He could have gone to his room and packed and could have therefter returned to the desk to check out and collect his diamonds. Here the exception of "Coming and Going" will not apply.
