On section 5.4, it states “This section does not affect any deficiency of juristic competence or capacity that is attributable to insanity, or mental infirmity, or any other factor distinct from age. “I just want to confirm if this section states that the law above does not apply if a patient has mental health issues? (It’s an Australian law FYI)

Explanation / Answer

Age of majority act 1972 is the moment when minors are not to be considered children and has legal control over their acts, actions, and decisions, thus withholding the control and legal responsibilities of their parents or other guardian over them. Different countries has set different upper limits to this law

While If a patient has mental health issues the law does not hold true for example in case of Down's syndrome in which the mental growth ceases at a particular age which falls in minority group
