A contract called for the building of a large oil tank on sandy soil near a wharf. All plans were drawn in accordance with the Engineer's design. Under one edge of the area to be occupied by the tank the contractor unexpectedly encountered a group of old wooden piles that had been covered by sand and were not shown on any of the plans. The contractor cut the wooden piles just below the future tank bottom, and he covered them with a small amount of compacted dirt. The contractor did not report the situation to the Engineer, who knew nothing about the piles. When the completed tank was tested, by filling with water, the greater resistance of the piles (compared with the bearing value of the neighboring soil) caused uneven settlement: as a result, the side of the tank over the piles buckled. Who is responsible for remedying the situation? Explain

It's complicated really buddy! But let us try .As you mentioned Engineer don't know about the piles due to sand cover on them .To execute a project proper site investigation should be made so that all the unexpactation get cleared , I Can say this is a lack of proper site investigation .The first fault was of project manager and 2nd fault was of contracter as he is corrupt .Project manager and contracter both are responsible for remedying situation.
