2. There are two basic advance directives: living wills and durable power of attorney for healthcare. The patient self-determination Act (PSDA) requires healthcare institutions to provide written information to clients concerning the client's rights under state law to make decisions, including the right to refuse the treatment and formulate advance directives. The hospital is also considered to ensure the state law is followed and provide education for the staff and the public concerning living wills and durable power of attorney. It is especially important to understand clients cultural beliefs when explaining advanced directives. The determination of legal competency is made by a judge, and the determination of decisional capacity is usually made by the physician and the family.

Living wills are written documents that direct treatment in accordance with the client's wishes in the event of terminal illness. Generally, two witnesses neither of whom can be a relative or physician, are needed when the client signs the document.

A durable power of attorney for health care designates an agent, surrogate, or proxy to make healthcare decisions if and when the client is no longer able to make decisions on his or her own behalf. This agent is appointed to make health care treatment decisions based on the client's wishes.
