Question

Scenario #4: The actions taken against a nurse’s license are public knowledge. Many state boards of nursing publish this information routinely. The state of Wisconsin publishes a newsletter that includes this information four times a year. Go to the following link. http://dsps.wi.gov/Boards-Councils/Board-Pages/Board-of-Nursing-Main-Page/Board-of-Nursing-Newsletters/?utm_medium=email&utm_source=govdelivery Once there click the January 2017 link. Scroll through the newsletter. At the end you will see the actions taken by the board of nursing. Click on several of the Registered Nurse cases (it shows in the right column what type of nurse, and you can open the case by clicking the link in the far left column that says ‘Order No’) and read about them. Look at the case listed of ‘Amanda Anderson’ (the first one listed).

1)What legal issues exist in this case?

2) What ethical issues exist in this case?

3)If you were working with this nurse and noted the behaviors, what would you do and how would you communicate this?

4) Are there other cases that you found interesting? Why?

Explanation / Answer

1.The legal issues relates to patient safety and quality of life, environmental factors ,health and safety, error reduction and ethical boundaries of nursing practice. All these are listed in the given case as the nurse practitioner was unable to walk or move properly, she has a problem of speaking properly and even her behaviour was strange enough as observed. This could become a threat to patients life ,because the nurse eyes were constricted, and she will not be able to treat patient further.Even she was not able to remember anything and it was observed as she was affected with amnesia which states that she will unable to recall memories.

2.Nurses have a duty to care for patients and not to abandon them, the balance of professional responsibility and risk including moral obligations and options inorder to preserve the thical mandates in situation of risk to the nurse or proffession. But in this case nurse herself was unable to look after the necessities she needs to fulfill. She was not even attending her primary care physician prior to the appointment as she forgot.

3.Nurses shouldnt have handled troublesome situations on their own.In such situations they should try to request assistance from their peers and leaders within their practice.THey should be informed by the staff to the physicians as soon as they observe such healthconditions. The doctors should make them talk and listen to them as they may be in stress situations sometimes. She should be instructed to consult a doctor and psychiartist before any health errors occurs. She should be treated in agood way and one should be listening to her with patience and deal her in a subtle way.

4.The legal orders given by the board of nursing is quite interesting as they are not directly terminating her but given her a chance to fulfil her duties by just giving a suspension order.Even if she will not be able to prove herself through medical reports ,extra time is also alloted to her for thorough recovery of the nurse practitioner.
