Late one Friday evening Vinnie Hanks was driving home after spending several hours in a public bar watching the big game. He failed to stop at a red light and collided with a 1959 convertible, in which four high school students were out for a jaunt. Three of the students were killed. Hanks was uninjured and he ran from the scene. When the police arrived at the scene they were able to trace the owner of the vehicle and when police officers arrived at Hanks’ house he was found in an obviously intoxicated state. He told the police that he had panicked and left the scene and had been drinking only since his arrival at home. Blood was taken for alcohol testing. Is there any evidence in law to establish that Hanks was over the drink-driving limit at the time of the accident? How could this be established?
