Question

From the point of view of violation of public policy or breach of a covenant of good faith and fair dealing, what would be the outcome for these 2 cases:

1. A company's lawyer is terminated when he refuses to remove, from the company's files, documents that would be harmful to the company if they were given to opposing counsel under a discovery order in litigation the company is involved in.

2. Employee discovers that his supervisor is involved in a wrongdoing. The supervisor terminates the employee to prevent the employee from disclosing her wrongdoing to higher-level management.

Explanation / Answer

1.) The company is at risk criminally and civilly because not only did he wrongfully fire an employee, the firm also attempted to tamper evidence. 2.) Wrongful dismissal is only a civil matter. Unless your actions are specifically covered by state-by-state whistleblower laws, you will only be compensated in punitive damages, backpay, or reinstation.
