Darla is a Master’s of Arts in Professional Counseling student working at her practicum site. Mike is a practicum student assigned to the same practicum site as Darla. Both Darla and Mike report directly to the same site supervisor. About halfway through the practicum, Darla realizes that many of the clients assigned to Mike for counseling are coming to see her. Comments from Mike's clients have led Darla to believe that Mike is acting unethically. How should Darla handle this situation? What are the ethical and legal implications? 

If Darla tells her supervisor, and her supervisor does not act on her concerns, what are the ethical and legal implications?

Darla should handle the situation by:

Darla should report immediately to the supervisor and explain the situation. Handle those clients who come to her in a pleasant way. Talk to the Mike about the issue and to identify what is the issue and help her to act in a ethical manner, if not what ethical and legal complications will arise.

Ethical and legal implications:

Each professional counsellor has enormous responsibility to uphold the public trust, and must seek high levels of training, education, and supervision in the ethical application of counselling practices.

Ethics to be based on five moral principles,

Autonomy- refers to the abillity to take ones own decisions independently.

Justice- Treat the each and every individual in a fair manner

Beneficience-Means doing good or what is the best intrest of the client

Nonmaleficience-Means doing no harm to the client

Fidelity- involves the concept of loyality, faithfullness and honoring commitments

Legal implications:

Laws are more prescriptive than ethical standards and have been incorporated into the code and carry greater sanction or penalties for failure to comply. When ethics and laws appear appear conflict wih each other, the counselor must resolve it in a responsible manner.

If they are unable to maintain the legal and ethicalstandards they will be processed to the laws, if they cross the professional relation ethics and harming the client in any manner either physically or mentally.
