The article is about types of theft and the various ways of theft. Larceny, Embezzlement and misappropriation of funds are the common type of theft.

Misappropriation of funds means use of money for his own purposes by a person who is not the owner of fund but is in possession of fund because the owner has entrusted him with it. Misappropriation of funds is a kind of embezzlement. To prove misappropriation of cash in the court it must be proved that the person convicted of misappropriation was in possession of money with the consent of the owner only as a custodian and not as the owner. Further it is required to be proved that misappropriation was intentional and not by mistake or unknowingly and there was an error only. The other thing that must be proved in the court is the person not only take the money but also used it for its own purpose and it does not matter if the person convicted later return the money to the owner.

Penalty on misappropriation of funds depends on the local law where the cause of action arises. But there may be severe penalties for this. Common type of penalties for misappropriation of funds are imprisonment upto 10 years, significant fines may be imposed on the person convicted, Probation sentences are also possible with misappropriation convictions and the person who is convicted of any type of theft, including misappropriation of funds, must typically pay restitution to the victim. So, this is a serious crime.
